Roufeil as Trustee of the Bankrupt Estate of Tarrant v Tarrant Enterprises Pty Ltd

In Roufeil as Trustee of the Bankrupt Estate of Tarrant v Tarrant Enterprises Pty Ltd as Trustee for the MRT Family Trust [2023] FCAFC 142 a Full Court of the Federal Court allowed an appeal from a judgment of the Federal Circuit and Family Court of Australia (Division 2) which had held that payments into a loan account were not “payments of money” for the purposes of sections 120 and 121 of the Bankruptcy Act.  Their Honours held that the statutory phrase “payment of money” bears its ordinary meaning and the mere fact of receipt of value is sufficient to constitute a payment of money.

Jonathan joins the Floor from the Aboriginal Legal Service, where he was a trial advocate appearing in trials and appeals in NSW and the ACT Supreme Court.

In 2010 he was Associate to Judge Zahra SC. For the next four years, he worked in public and commercial law at Herbert Smith Freehills. He then moved to the Northern Territory and became practice manager at the North Australian Aboriginal Justice Agency in Darwin.

Jonathan accepts briefs in all areas of the law, with a particular focus on criminal law, commissions of inquiry and inquests.

John commenced his career in law as a tipstaff and researcher in the Common Law Division of the Supreme Court of NSW. He then worked as a solicitor at HWL Ebsworth in the workers’ compensation team. Prior to joining the bar, John was a Senior Federal Prosecutor at the Office of the Commonwealth Director of Public Prosecutions.

John accepts briefs in all areas of the law with a particular focus on federal criminal law.
